Revise pretrial diversion laws

Pre-trial diversion or, deferred prosecution agreements, are civil contractual agreements that we use on rare occasion in the criminal arena when a specific suspect or alleged crime does not warrant the intervention and resources of the judicial system. Often diversions are cases in which the person's conduct may not rise to the level of a prosecutable crime but reveals an issue that needs to be addressed, such as alcoholism. The cases are "diverted" off of the criminal justice track, away from the courts, by agreement of the parties, not the judge. This bill would make the statute and practice more internally consistent."

    Missoula County supports House Bill 195 - Revise pretrial diversion laws, on the House floor this afternoon and thanks Representative McConnell for carrying the bill. Pretrial diversion or, deferred prosecution agreements, are civil contractual agreements that used on rare occasion in the criminal arena when a specific suspect or alleged crime does not warrant the intervention and resources of the judicial system.
