Revise jury selection laws

    Missoula County supports Senate Bill 139 - Revise jury selection laws, before Senate Judiciary this morning, and thanks you for carrying the bill, Senator Sands. This bill is a step in the right direction towards reducing the number of jurors who do not respond to a jury summons (because they've most likely moved) and the number of undeliverable jury questionnaires/summons returned by the post office to the Clerk of Court office. Jurors who do not respond to a summons or notice of jury service must be served by the Sheriff so this should also reduce the number of jurors who require service by the Sheriff. Please support SB 139.

  3. The Montana Association of Clerks of District Court strongly supports this bill. Inactive electors become non-responding jurors. Clerk of court staff members spend countless hours attempting to get jurors to respond to the annual notices and the summons to report for a jury trial. By statute, personal service must be attempted by the county sheriff on jurors who do not respond. The sheriff's office does not have the manpower to keep up with the high number of jurors sent for service. For September jury trials alone, the Missoula County Clerk of District Court office sent 253 packets (for non-responding jurors) to the sheriff for service. The were able to service only 60.

    Since the election administrator already sends notices to inactive electors, it is a duplication of efforts for the clerk of court and sheriff to also make attempts to get these electors (now jurors) to respond. Keep in mind that the juror list is a combined list of register electors and licensed drivers/holders of MT ID cards. So if an inactive elector were to be inadvertently placed on an inactive list, the name would still be included on the jury list as a licensed driver or holder of a MT ID card.
